3. Proposals and Scope

Unless otherwise stated, proposals and quotations are valid for 14 days from the date of issue.

Pricing is based on the project information and requirements available at the time the proposal is prepared.

Any additions, revisions or changes outside the agreed scope may require a revised quotation, additional fees and an adjusted delivery timeline.

4. Client Responsibilities

You agree to:

  • Provide accurate and complete project information
  • Supply required content, images and branding materials
  • Provide website, hosting and platform access when required
  • Respond to feedback and approval requests promptly
  • Ensure supplied content does not infringe third-party rights
  • Review and approve deliverables before publication

Delays caused by incomplete information, missing access, delayed feedback or late approvals may affect the delivery schedule.

5. Fees and Payment

Fees and payment schedules will be outlined in the relevant proposal, invoice or service agreement.

Unless otherwise agreed:

  • Deposits must be paid before work begins
  • Recurring services are invoiced in advance
  • Invoices must be paid by the stated due date
  • Final files, launches or account transfers may be withheld until all outstanding invoices are paid

Third-party expenses, advertising budgets, premium software, hosting, domain registration and licence fees are separate unless expressly included in writing.

6. Third-Party Platforms

Our services may involve third-party platforms and providers, including Google, Meta, LinkedIn, hosting providers, software tools, plugins, APIs and payment gateways.

We are not responsible for outages, policy changes, account restrictions, security incidents, pricing changes or service interruptions caused by third-party providers.

7. Intellectual Property

You retain ownership of the logos, content, images, branding materials and other assets you provide to us.

Million Hits Australia retains ownership of its internal processes, reusable code, frameworks, templates, strategic methods, preliminary concepts and proprietary materials.

Once all applicable invoices have been paid, ownership or usage rights for approved final deliverables will be provided as outlined in the applicable agreement.

Third-party fonts, plugins, stock images and licensed software remain subject to their individual licence conditions.

8. Privacy and Data

Personal information submitted through our website or provided during a project will be handled in accordance with our Privacy Policy.

By submitting an enquiry, you consent to us contacting you regarding your request and relevant Million Hits Australia services.

9. Limitation of Liability

To the maximum extent permitted by law, Million Hits Australia is not liable for indirect, incidental, special or consequential loss, including loss of revenue, profit, data, opportunity, reputation or anticipated savings.

Where liability cannot legally be excluded, our liability may be limited to resupplying the relevant services or paying the reasonable cost of having the services supplied again.

Nothing in these Terms excludes rights or remedies that cannot be excluded under the Australian Consumer Law.

We may update these Terms and Conditions when our services, business practices or legal obligations change.
